Fireworks Ordinance

On November 14, 2022 the Birmingham City Commission adopted Ordinance No. 2372, which regulates the discharge of fireworks within the City. The City under Michigan the law must allow fireworks during the listed days and holidays, however they must follow the City adopted ordinance when discharging fireworks in order to avoid a fine. 

The Fire Department strongly discourages the use of high-impact aerial fireworks in the City due to the risk of fire, injury, and noise pollution to neighbors and animals.  All violations of the firework Ordinance will be investigated and fines will be issued.  Please be safe and limit the use of fireworks.

Summary

It shall be unlawful for any person to ignite, discharge or use consumer fireworks, as such term is defined in the Ordinance except for the use of consumer fireworks from:

  • 11:00 a.m. on December 31 - 1:00 a.m. on January 1
  • 11:00 a.m. - 11:45 p.m. on Saturday and Sunday immediately preceding Memorial Day
  • 11:00 a.m. - 11:45 p.m. on June 29 and 30 and July 1, 2, 3, and 4
  • 11:00 a.m. -11:45 p.m. on July 5, if that date is a Friday or Saturday
  • 11:00 a.m. - 11:45 p.m. on the Saturday and Sunday immediately preceding Labor Day

A person shall not ignite, discharge, or use consumer fireworks on public property (i.e. sidewalks, streets, easements, etc.), school property, church property, or the property of another person without that organization's or person's express permission to use those fireworks on those premises. Except as otherwise provided in this subsection, a person that violates this subsection is responsible for a civil infraction and may be ordered to pay a civil fine of not more than $1,000.00.

Damages (i.e. burns, soot stains, fire, etc.) from fireworks to the property of another person will be investigated and a fine of $500 fine may be issued.

If a person intentionally or recklessly causes litter and/or debris from the use of fireworks onto the property of another, or public property, the person is responsible for a civil infraction punishable by a fine of up to $500.00.

Consumer fireworks shall not be ignited, discharged or used by a person under the influence of alcoholic liquor or controlled substance or a combination of both.

Low-Impact fireworks shall not be ignited, discharged or used by a person under the influence of alcoholic liquor or controlled substance or a combination of both.

Unmanned Free-Floating Devices. Any unmanned free-floating device (sky lantern) which requires fire underneath to propel it and is not moored to the ground while aloft, have an uncontrolled and unpredictable flight path and descent area so as to pose a potential fire risk and are therefore prohibited.
